Terms and Conditions for Auto Europe's Best Summer Holiday Competition

1. How to enter:

To enter the competition, share a picture of your best summer holiday destination telling us where it is and why you had such a great time by leaving a comment on the relevant competition post. The winner will be drawn from the valid submitted entries and will be awarded a weekend car hire up to a total value of £50.

Entries can be submitted from 14.08.2019 until 11.59pm on 26.08.2019.

2. Terms and Conditions:

The entries to the competition are subject to the following terms and conditions:

• One winner will be selected from all valid entries and will receive a weekend car hire up to a total value of £50, subject to availability.

• The weekend car hire is only available for reservations with pick-up from Fri – Mon, requested until 31th December 2019 and with pick-up until 31st Ausgust 2020 at the European destinations where Auto Europe (hereinafter referred to as 'the Promoter') offers a car hire, and applies to the following car categories: Mini, Economy, and Compact, up to a total value of £50. Drop-off must take place by Monday 10AM.

• No cash alternative will be given should the total value of the weekend car hire be less than £50, and the winner will not be reimbursed the difference between a lower price and the total value of £50. Should the total value of the weekend rental exceed £50, the winner will then be given an £50 discount and will thereafter be required to pay the difference between the total value of the rental and the discount. The total value of £50 for the rental only applies to mandatory rental costs and excludes any fees, taxes, surcharges, optional extras, one way drop of fees, and fuel.

• Only residents in the UK aged 21 or over with a valid driving license are eligible to enter. Rental restrictions may apply to clients younger than 25 years old and older than 74 years old. Entries are limited to one per person. Internet access is required.

• Employees of the Promoter or of any business involved in or associated with the prize draw, as well as employees of any of the Promoter's agencies and of any of their parent and/or affiliate companies, as well as the immediate family (spouse, parents, siblings and children) and household members of any such employee are not eligible to enter. The Promoter reserves the right to verify the eligibility of any contestant.

• The prize is non-refundable, non-transferable, non-changeable and no cash alternative will be given.

• The Promoter reserves the right at its absolute discretion to substitute another prize of similar or greater value.

• Entries will be accepted online on our UK Facebook page.

• To enter the prize draw, users must share a picture of their best summer holiday destination and leave a comment on the relevant competition post telling us where it is and why this is the best place to spend summer.

• Entries will be deemed ineligible and may be deleted if they contain material that is: a) inappropriate, offensive, indecent, obscene, hateful, defamatory, derogatory or anything similar; b) promotes irresponsible driving; c) promotes bigotry, racism, hatred or harm against any group or individual, or that promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age.

3. Duration and prize draw:

• The prize draw opens on 14.08.2019 and lasts until 11:59pm on 26.08.2019.

• From all valid entries submitted, the winner among users who shared a picture and left a comment on the competition post will be chosen at random on 27.08.2019.

• The winner’s name will be announced through a new post on our UK Facebook page on 27.08.2019 and contacted by the Promoter via an inbox message on Facebook. Proof of age may be required.

• Contestants acknowledge that other contestants may have submitted ideas and concepts that may be similar to their entry, and that they are not entitled to any compensation or right to negotiate with the Promoter over such matters. The Promoter is not responsible for any lost, late, incomplete, invalid, unintelligible or misdirected entries, which will be disqualified. No responsibility can be accepted for any technical failures of any kind, any incomplete or incorrectly completed entries, any unauthorized intervention in any part of the entry process, or any entries not received for whatever reason. Neither the Promoter nor any appointed agent will accept responsibility for any technical or other error that might occur in the administration of the prize draw or the processing of entries.

• In the event of any dispute regarding the prize draw, the decision of the Promoter is final, and neither the Promoter nor any of its agents will enter into any correspondence or discussion on the subject. The Promoter reserves the right to disqualify any contestant if it has reasonable grounds to believe the contestant has breached any of these terms and conditions.

• Any personal data provided or disclosed by the contestant will be used solely in accordance with current German data protection law, and will not be disclosed to third parties without the contestant's prior and explicit consent except where necessary to satisfy the terms of the rental agreement with the supplier of the vehicle provided as part of the prize draw.

• By entering this prize draw, you hereby state that all the information submitted by you is true, current and complete.

• Any information submitted by you must be personal to and relate specifically to you. You hereby state that the information submitted and/or distributed by you does not infringe the intellectual property, privacy or any other rights of any third party, and does not contain any defamatory, obscene, indecent, harassing or threatening material.

• The Promoter reserves the right, at its sole discretion, to remove and disqualify any entry that does not adhere to these terms and conditions.

• The Promoter will take all reasonable steps to avoid causing undue disappointment to clients, but reserves the right to amend or withdraw this promotion where necessary if circumstances arise that are beyond its control.

• Winners may be required to take part in any publicity accompanying or resulting from this prize draw. By entering this prize draw you hereby assign to the Promoter the complete copyright and all other intellectual property rights over the submitted entry, which may be used in any promotional or advertising materials or similar arising from or connected with this prize draw.

• The Promoter reserves the right to disqualify any individual it finds to be tampering with the operation of the prize draw or to be acting in violation of these terms and conditions or in an unsportsmanlike or disruptive manner. Any deliberate attempts by any person to undermine the legitimate operation of the prize draw may be a violation of criminal and civil law and, should such an attempt be made, the Promoter reserves the right to seek damages from any such person to the full extent of the law.

• The Promoter's failure to enforce any of these terms and conditions shall not constitute a waiver of that provision.

• Except where prohibited, entrants agree that: (1) any and all claims, judgements and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this prize draw, but in no event legal fees; and (2) under no circumstances will entrants be permitted to obtain awards for, and entrants hereby waive all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than actual out-of-pocket expenses, and any and all rights to have damages otherwise increased. Subject to any liability arising as a result of its fraud or fraudulent misrepresentation, the Promoter's liability for claims related to this promotion is limited to a maximum of three thousand euros.

4. Disclaimer

• To the extent permitted by law, the Promoter is not liable for any injury or damage to persons or property which may be caused, directly or indirectly, from any entrant's participation in the prize draw or from any prize.

• All issues and questions concerning the construction, validity, interpretation and enforceability of these terms and conditions shall be governed by and construed in accordance with the laws of Germany and the parties hereby agree to the exclusive jurisdiction of the German courts.

• This promotion is in no way sponsored, endorsed or administered by, or associated with Facebook. You are providing your information to the Promoter and not to Facebook. Entrants agree that Facebook shall have no liability in respect of this draw.
